The case could be refiled if it could be proven there were dangers to eating McDonald's food that were not commonly known.
The judge dismissed it, but explicitly pointed out these possible grounds to refile, which is not usual. And it has, in fact, been refiled. I don't know if there's much chance of the plaintiffs winning the refiled case, but having just read a book about Macdonalds and their food, I don't regard the case as being as ridiculous as most other people seem to.
